TRGB LTD REPLACEMENT PARTS Standard Terms of Agreement and Conditions of Sale
 
1. DEFINITIONS
 
“TRGB” means “TRGB LTD” (company details as per this our site) ‘Goods’ means any mechanical component or fabricated part supplied by TRGB.
 
2. BASIS OF CONTRACT
 
2.1 An order from a customer shall constitute an offer. 2.2 An invoice or written confirmation of order from TRGB constitutes an acceptance. In the case of a telephone sale the taking of credit card details by TRGB constitutes an acceptance. 2.3 All contracts are subject to these written terms. Variations to the terms or representations regarding the goods are not binding unless confirmed in writing by TRGB. 2.4 The price of the goods shall be the EBAY "BUY IT NOW PRICE" or "THE FINAL AUCTION PRICE" which may differ from the TRGB published price. The EBAY price is the price that must be paid to TRGB and this is INCLUSIVE of VAT (the vat will be shown as a seprate item on the invoice, but this will not affect the final price paid)If you bid from a country that is not laible to pay UK vat then you must still pay the full EBAY price for the item. 2.5 An order accepted as above cannot be cancelled by the customer.
 
3. PAYMENT
 
3.1 Customers who do not have an agreed credit account must make payment in advance, with the order. 3.2 Payment is to be by cash, Access, Visa, Mastercard, Connect, Switch, banker’s draft,pay pal, or other guaranteed funds. TR GB reserve the right not to dispatch goods until payments have been cleared.
 
4. DELIVERY
 
4.1 Delivery charges will be shown on the invoice.EBAY quoted delivery charges are INCLUSIVE of VAT.(if vat is applicable) Delivery charges are quoted on the sale item on ebay. 4.2 Any dates quoted for delivery of goods are approximate only and not a term of the contract
 
5. RETURNS
 
5.1 Goods are not supplied on a sale or return basis. (subject to 5.4) 5.2 Returns will only be accepted if previously agreed in writing by TRGB. Where the part ordered by the customer is supplied, but not the one which the customer really requires, then TRGB may agree to exchange it but there will be a handling charge of 15% of the price of the replacement goods. TRGB will waive the handling charge where the replacement goods are of the same or greater price than the returned goods and where the returned goods are received back by TRGB intact and undamaged. Any other returns will be stored at the customer’s expense.(subject to 5.4) 5.3 Replacement goods must be paid for in advance as set out in 3 above.(subject to 5.4) 5.4 Under the distance selling regulations, you have the right to cancel your order for any item purchased on this website within 7 working days starting from the day after delivery. We will issue you a full refund (excluding carriage charges) within 30 days of the date of cancellation. This does not apply to items personalised or made to your specification. (for example seat covers and trim “made to order”) To cancel, you can e mail us (use “enquiry” page) or write to us within 7 days of delivery of your item(s) quoting your order or invoice number. You must take all reasonable care of the item(s) and must not have used or fitted them. The item(s) may then be returned to us, must be securely packaged, and sent to our address (see below). PLEASE NOTE: you are responsible for the cost of returning the goods to us (unless they were delivered to you in error or the goods are faulty). After 7 working days then surcharges will apply (see 5.1 to 5.3 above)
 
6. TITLE TO THE GOODS
 
6.1 Risk passes to the customer on delivery. 6.2 Title only passes to the customer on payment. 6.3 Until payment the customer holds the goods as agent and bailee only, must store the goods properly, return them to TRGB if requested and pay to TRGB any monies received for the goods.
 
7. LIABILITY
 
7.1 TRGB are not liable for the consequences of incorrect fitting or use of goods supplied. 7.2 TRGB are not liable to the customer by reason of any delay or failure to perform arising from circumstances beyond the control of TRGB. 7.3 TRGB are not liable for problems for damages arising from failure by the customer to supply full or correct information. 8. LOSS IN TRANSIT
 
8.1 If the customer’s goods do not arrive within a reasonable time, the customer should report to TR GB who reserve the right to investigate before despatching replacement parts. 8.2 Urgently required parts despatched before investigations are complete must be paid for in addition by the customer as set out in 3 above. The customer will be reimbursed where TRGB succeed in settling loss with the carriers or third parties.
 
9. GENERAL
 
9.1 There should be no alteration in these terms and conditions save as confirmed in writing by TRGB. 9.2 If any of these terms and conditions is or becomes invalid, illegal or unenforceable in law, the remaining conditions shall not be affected. 9.3 The law applicable to the Agreement is the law in England and Wales and the customer will submit to the jurisdiction of the English and Welsh courts.
 
TRGB LTD IS A REGISTERED LTD COMPANY AT OUR TRADING ADDRESS (AS PER OUR WEB SITE) AND IS VAT REGISTERED.
