1. PLACING YOUR ORDER
1.1 You must be over 18 years of age to place an order and any purported order placed by a minor is void.
1.2 By placing an order you make an irrevocable offer to The History of Formula 1 to purchase the products you have selected.
1.3 Your order will be considered to have been accepted by The History of Formula 1 only if and when the products are despatched by The History of Formula 1 to you and any agreement for the sale and purchase of the products will be formed only upon The History of Formula 1 despatch of the products to you.
1.4 If The History of Formula 1 accepts your order, it will not file the concluded agreement and you will not be able to access it later. It is your responsibility to download, save and/or print off any documents and receipts which make up your order.
2. PRICING AND AVAILABILITY
2.1 The History of Formula 1 reserves the right to alter prices on the eBay at any time without prior notice but such alteration shall not affect a previously accepted order.
2.2 While The History of Formula 1 does its best to ensure that all information on the eBay is accurate, there may be occasions when, prior to the despatch of the products under your order, The History of Formula 1 discovers an error on the eBay relating to the products (including, without limitation, their price, description, availability or delivery), which prevents The History of Formula 1 from accepting your order and/or despatching the products. In such circumstances, The History of Formula 1 will contact you (including by e mail) and ask whether you would like to reconfirm your order for the products (with the error(s) corrected), or whether you would like to cancel your order. If you choose to cancel your order, The History of Formula 1 will refund to you any money that you have paid to The History of Formula 1 in respect of your order.
3. PAYMENT
3.1 You may pay for the products by eBay Managed Payments.
4. DELIVERY
4.1 The History of Formula 1 aims to deliver the products within reasonable time after an order is placed but shall not be liable for the consequences of any delay or failure to deliver within any agreed time. For more information please consult the Delivery & Returns page.
4.2 Title to and risk for the products will pass to you on delivery of the products.
4.3 If any products you purchase from The History of Formula 1 are defective or incomplete you may return them to The History of Formula 1 by following the returns procedure. However, if the products are delivered to you in a damaged state you must notify The History of Formula 1 Immediately.
5. CANCELLATION
5.1 The History of Formula 1 operates a thirty (30) day no quibble cancellation policy. If you wish to cancel our Agreement and return any products, for whatever reason, you may do so up to thirty (30) Working Days following the day after delivery of the products by notifying The History of Formula 1 in writing or via eBay messages.
5.2 If you cancel the Agreement in accordance with Clause 5.1 above:
(a) you must return to The History of Formula 1, at your cost, any products delivered to you under the cancelled Agreement. You are under a statutory duty to take reasonable care of the products while they are in your possession. Taking reasonable care means you must return the products to The History of Formula 1 in 'as new' condition, with their original packaging and complete with any accessories and free gifts offered with them. If you fail to take reasonable care of the products while they are in your possession and return the products to The History of Formula 1 in a damaged state, The History of Formula 1 may take action against you to recover any loss in value of the products arising from your breach of this statutory duty.
(b) The History of Formula 1 will provide you with a full refund of the purchase price and any delivery charges you have incurred in getting the products to you no later than 30 days from and including the day on which you notified The History of Formula 1 of your intention to return the products in accordance with Clause 5.1.
(c) If you cancel the Agreement in accordance with Clause 5.1, but The History of Formula 1 does not receive the products, then The History of Formula 1 is entitled to recover the products from you and to offset the direct costs of recovering the products against the refund due to you.
6. TERMINATION
The History of Formula 1 may terminate this Agreement with immediate written notice if:
1) you fail to pay on time;
2) you breach, or The History of Formula 1 reasonably suspects you have breached, Export Laws; or
3) The History of Formula 1 does not have in stock the products you placed an order for.
7. LIABILITY
7.1 This Clause 7 sets out the full extent of The History of Formula 1 obligations and liabilities in respect of the supply of products to you.
7.2 The maximum aggregate liability under the Agreement of The History of Formula 1, any other party (whether or not involved in creating, producing, maintaining or delivering this eBay), and any of The History of Formula 1 affiliated companies and the officers, directors, employees, shareholders or agents of any of them, whether in contract, tort (including negligence) or otherwise, shall in no circumstances exceed the amount payable by you to The History of Formula 1 in respect of the products in question.
7.3 None of the provisions of this Clause 8 affect your statutory rights as a consumer.
8. EXPORT CONTROL
You agree to comply with all Export Laws. you agree (i) not to export any Product to any country in contravention of any Export Law, and (ii) not to export any Product to any country for which an export licence or other governmental approval is required, without first obtaining all necessary licences or other approvals. You warrant that you are not located in, under the control of, or a national or resident of any country to which export of the products is prohibited by any Export Law.
9. GENERAL
9.1 The History of Formula 1 will make every effort to perform its obligations under the Agreement. However, The History of Formula 1 cannot be held responsible for delays or failure to perform if such delay or failure is caused by any circumstances beyond The History of Formula 1 reasonable control. In the event of a delay, The History of Formula 1 will perform its obligations as soon as reasonably possible.
9.2 The History of Formula 1 may revise these Terms and Conditions of Sale at any time. You should check the Terms and Conditions of Sale immediately prior to placing an order as you will be contractually bound by the Terms and Conditions of Sale posted on eBay and presented to you for your acceptance at the time you place your order.
